Wine Finder User Terms

These terms apply when you request or use a wine recommendation from the My Next Wine Wine Finder embedded in a merchant's Shopify shop. By selecting the button to request recommendations, you agree to these terms to the extent permitted by applicable law.

1. The shop — not My Next Wine — sells the wine

My Next Wine supplies recommendation technology to the independent merchant whose shop you are visiting. My Next Wine does not advertise or offer that merchant's wine for sale in its own name, does not own or possess the wine, does not set the merchant's retail prices, does not take your wine payment and is not the seller, reseller, importer, distributor, producer, warehouse, delivery carrier or alcohol-licence holder.

Any purchase contract is solely between you and the merchant. The merchant is the seller of record and is responsible for product information, price, stock, checkout, payment, taxes, age verification, delivery, cancellations, refunds, returns, statutory guarantees and customer service. The merchant's terms of sale and privacy notice also apply.

2. The merchant owns the customer relationship

You remain a customer or prospective customer of the merchant, not of My Next Wine merely because you use the Wine Finder. My Next Wine does not acquire ownership of the merchant's customer account, customer relationship, customer list, lead or associated goodwill. My Next Wine does not use Wine Finder preference answers to market wine directly to you or to build a reusable direct-to-consumer marketing profile.

3. AI-assisted, subjective guidance

Recommendations are automated and AI-assisted, although deterministic validation and fallback logic may also be used. They use the answers you provide, information supplied by the merchant, mapped wine information, price constraints and reported availability. Wine taste and food pairing are subjective. A recommendation is guidance only — not a guarantee that you will like a wine, an expert certification, or medical, nutritional, allergy, legal or other professional advice.

Catalogue information may be incomplete, inaccurate or out of date, and price or stock may change before checkout. Always review the merchant's final product page and checkout details before buying. Do not rely on the Wine Finder for allergy, intolerance, pregnancy, medication, health or responsible-consumption decisions.

4. Wine quality and fulfilment

My Next Wine does not inspect, test, store, handle, pack or deliver wine and cannot verify authenticity, provenance, vintage, condition, allergens or freedom from cork taint, oxidation, heat damage, breakage, substitution, shortage, misdescription or recall. Questions or claims about a product, payment, delivery, refund, replacement or injury should be directed to the merchant. Nothing in these terms removes any mandatory consumer right or claim you may have against the merchant or another responsible party.

5. Who may use the Wine Finder

You may use the Wine Finder only if you are legally permitted to view and purchase alcohol in your location and meet the merchant's age requirements. You must comply with applicable law and use the Service responsibly. You must not misuse, attack, scrape, reverse engineer, overload or submit unlawful, abusive, malicious or rights-infringing content to the Service.

6. Your answers and privacy

Provide only wine-preference and food-pairing information needed for a recommendation. Do not enter names, contact details, account information, payment information, health information or other sensitive personal data in free-text fields. The applicable Privacy Statement explains how recommendation inputs and technical data are processed. My Next Wine does not sell shopper personal data.

7. Availability and third-party services

The Wine Finder is provided on an as-available basis and may be changed, interrupted, suspended or withdrawn. Its operation can be affected by the merchant's catalogue, theme, hosting, internet connection, Shopify, WooCommerce, WordPress and other third-party services. My Next Wine does not guarantee uninterrupted operation or that every wine will be identified, available or suitable.

8. Liability and mandatory rights

Nothing in these terms excludes or limits liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, wilful misconduct, or any liability or consumer right that cannot legally be excluded or limited.

Subject to those protections and to the fullest extent permitted by applicable law, My Next Wine is not liable for the merchant's products, descriptions, prices, stock, sale, payment, age checks, fulfilment, delivery, refund decisions or customer service, or for loss arising from relying on a subjective recommendation. My Next Wine is not liable for indirect or consequential loss or for business loss incurred by a person using the Wine Finder for commercial purposes.

9. Intellectual property

My Next Wine and its licensors own the Wine Finder software, recommendation technology, mappings, designs and related content, excluding merchant content. You receive only a limited, revocable right to use the Wine Finder for its intended personal shopping purpose.

10. Law, disputes and changes

These terms are governed by Irish law, but this choice does not deprive you of mandatory consumer protections that apply in the country where you live. You may bring proceedings in any court available to you under non-excludable consumer-jurisdiction rules. Before bringing a claim against My Next Wine, please contact us so we can try to resolve it.

These terms may be updated for legal, security or Service changes. The current version will be published here. Changes do not retrospectively remove mandatory rights or liability that already arose.
